TERM
The Contest will run from 12 AM PST, October 5, 2009 until 11:59 PM PST, November 8, 2009.
THE PRIZES
First Prize Winner shall receive:
- A brand new Wacom Cintiq 12WX
Second Prize Winner shall receive:
- A brand new Wacom Intuos4 Small
Third Prize Winner shall receive:
- A brand new Wacom Bamboo Fun
Five Runner Up Winners shall receive Whirled buttons.
First, Second, and Third prize winners outside of the United States of America or Canada will receive the cash value of the prize, due to shipping and customs issues.
Winning entries will be featured on a winner announcement page until the beginning of the next Design Your Whirled contest.
ODDS OF WINNING
The winners are determined on the basis of the merits of the submission as set out in these rules as well as the number of entries.
HOW TO PARTICIPATE IN THIS CONTEST
- This contest is only open to Whirled members who are 13 years or older as of October 5, 2009.
- Signing up for the contest: You must be a registered member of www.whirled.com in order to submit a submission to the contest. No payment or fee is required for registration. You must agree to receive Email/Notes regarding the "Design Your Whirled"contest. You must maintain your email address active and current throughout the contest.
- If you are already a registered user of www.whirled.com you are not automatically entered into the "Design Your Whirled" Contest - you must submit entries in the fashion required by these rules to enter.
- Entries will only be accepted in electronic form by submission through the Three Rings' submission process. Entries must be submitted during the Term to the "Design Your Whirled" Contest Thread. The submission must be in electronic form.
ELIGIBILITY
- Anyone who is 13 years of age or older at the closing date of the "Design Your Whirled" contest may participate in this contest, or if you are under 13 years of age, you must have parental or legal guardian consent to enter the contest. The parent or legal guardian may be required to submit identification to Three Rings and confirm their consent telephonically. Contact Whirled for additional information required if you are under 13 years of age. By entering this "Design Your Whirled" contest you represent to Three Rings that you are either at least 13 years of age or have consent from a parent or legal guardian.
- Employees and volunteers of Three Rings and the judges, their immediate families and members of their households are not eligible to participate in this "Design Your Whirled" contest. By registering to win the prize, the winner grants www.whirled.com permission to use his/her name (including screen name) and likeness for advertising and future promotion purposes without additional compensation (except where prohibited by law).
- Anyone who has won any of the top 3 prizes in previous "Design Your Whirled" contests in the last 365 days is not eligible to participate in this "Design Your Whirled" contest.
DISQUALIFICATION
All of your entries will be disqualified, at the sole discretion of Three Rings, if you attempt to enter the "Design Your Whirled" contest through any means other than as described in these Official Rules; or to disrupt the "Design Your Whirled" Contest, circumvent the terms and conditions of these Official Rules, or in any way tamper with the "Design Your Whirled" Contest. If either of the above occurs, Three Rings has the right to remedy any such action, disruption, or circumvention, and to seek damages from you to the fullest extent permitted by law.
SELECTION OF WINNER
Winner and Runners up will be selected by a panel of jurors from Three Rings and the Whirled community. The Winner and Runners up will be notified at the time of selection by a member of the Three Rings staff, and have 4 days to contact Three Rings at the email address shown on the notification regarding acceptance of their prize all subject to satisfaction of eligibility requirements. Three Rings reserves the right to modify scheduling of the "Design Your Whirled" contest without prior notice. If the Three Rings staff or the judges determine in their sole discretion that there is any suspected or actual electronic tampering with the giveaway or if technical difficulties compromise the integrity of the giveaway, the judges reserve the right to void the entries at issue. Any finalist who does not comply with the Official Rules will be disqualified and the prize will be awarded to the next selected finalist in sequence. Return of any prize or prize notification as "undeliverable" will result in disqualification.
NOTIFICATION
The prize finalists will be notified by Whirled mail sent to the e-mail address on the www.whirled.com account. Three Rings is under no obligation to notify finalists by any means other than Whirled mail. You must be a registered member of www.whirled.com at the time that the prize is awarded. Three Rings is not responsible for notifications that are misdirected or not received because of e-mail addresses that are no longer correct. If a potential winner cannot be reached after a reasonable effort has been made during 4 business days from the first notification attempt, such person may be disqualified, and the prize will be awarded to the next selected finalist in sequence. Any prize notification or prize returned as undeliverable will result in the prize being awarded to the next selected finalist in sequence.
REDEMPTION
THREE RINGS WILL DETERMINE DELIVERY METHODS WITH THE FINALISTS VIA EMAIL. CONDITIONS: BY PARTICIPATING IN THE "Design Your Whirled" CONTEST, YOU AGREE TO RELEASE AND HOLD THREE RINGS, THE JURORS AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS, AND ALL PRIZE SUPPLIERS HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS, AND ACTIONS OF ANY KIND IN CONNECTION WITH THE "Design Your Whirled" CONTEST OR ANY PRODUCT PURCHASED, OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURIES, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY, WHETHER SUFFERED BY YOU OR A THIRD PARTY. THIS "Design Your Whirled" CONTEST IS VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW AND IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. BY PARTICIPATING, ENTRANTS AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THREE RINGS AND WAIVE ANY RIGHT TO CLAIM AMBIGUITY IN THE "Design Your Whirled" CONTEST OR THESE OFFICIAL RULES. All decisions regarding the "Design Your Whirled" contest, including, but not limited to, selecting winners, will be made by Three Rings, whose decisions shall be final. Finalists are solely responsible for all applicable federal, state and local taxes.
Except where prohibited by law, participants (and participants parent/legal guardian if participant is a minor) agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this "Design Your Whirled" contest shall be resolved individually, without resort to any form of class action, and exclusively by an action in state or federal court located in the State of California, County of San Francisco and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this "Design Your Whirled" contest but in no event attorneys' fees; and (c) UNDER NO CIRCUMSTANCES WILL CONTESTANTS BE PERMITTED TO OBTAIN AWARDS FOR AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of contestant and/or Three Rings in connection with this "Design Your Whirled" contest, shall be governed by, and construed in accordance with, the laws of the State of California without regard for conflicts of law doctrine of any jurisdiction.
Three Rings is not responsible for errors, omissions, interruptions, deletions, defects in part or whole, delays in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for any technical or non-technical network, telephonic, electronic, computer, hardware or software malfunctions of any kind, or inaccurate or partial transmission of or failure to receive entry information by Three Rings on account of technical problems or traffic congestion on the Internet, at any web site or any combination thereof. Three Rings is not responsible for any injury or damage to entrant's or any other person's computer related to or resulting from playing or downloading any materials in the "Design Your Whirled" contest, or for mail-in entries that are lost, late, misdirected, damaged, incomplete, altered, illegible or postage-due. Three Rings reserves the right to cancel temporarily or permanently the electronic method of the "Design Your Whirled" contest entries if it becomes technically corrupted.
